Court dismisses Akuapem Poloo’s appeal; orders her to continue 90-day jail term

An Accra Circuit Court today, Wednesday dismissed an appeal filed by actress Rosemond Brown which sought to challenge the 90-day jail term handed to her on April 16, 2021.

This means Akuapem Poloo will as a result serve 90-day jail sentence at the Nsawam Medium Security Prison.

In a ruling Wednesday morning (Dec 1, 2021), the Criminal Division of the court presided over by Justice Ruby Aryeetey upheld the Circuit court decision on grounds that the Circuit court’s decision was not manifestly excessive.

“This court will not interfere and the appeal is therefore dismissed,” Justice Aryee said.

Background:

On April 16, 2021, an Accra Circuit Court presided by Her Lordship Christina Cann has handed 90 days imprisonment sentence to actress Rosemond Brown over naked pictures published on social media with her son.

The sentence comes after she posted a naked picture with her son on Instagram celebrating his seventh birthday.
Rosemond Brown’s lawyers, consequently appeal her sentence to challenge the ruling of the Circuit Court.
The judge, Christina Cann, bemoaned the spate of nudity on Ghanaian social media space.

According to her, the punishment meted out to Rosemond Brown must serve as a deterrent to others.

The complainant in the case was Bright Appiah, the Director of Child Rights International Ghana.

The child’s right activist petitioned the police after the photo went viral on social media, and the matter was referred to the Domestic Violence and Victims Support Unit (DOVVSU).

A write-up accompanying the picture read: “I am naked in front of you because this is how naked I was giving birth to you, so in case you find me lying somewhere don’t pass by but see me as your mom who brought you to life.”

The prosecution said Rosemond after her arrest in 2020 admitted posting the nude picture with her son but insisted she did so unintentionally.

Akuapem Poloo, also filed an application for bail pending the determination of her appeal.

The actress was admitted to bail in the sum of GH¢80,000 with three sureties.

Justice Aryeetey, who granted Poloo bail ordered her to report to the police every two weeks and also deposit her passport at the court’s registry.
