Demoted AshantoGold SC has been ordered to pay a fine of GHc5,000 following withdrawal of the application for Injunction they filed against the Ghana Football Association.
The motive of the application was for the Appeals Court to halt the betPawa Premier League.
Ashgold had filed this application at the High Court (Human Rights), but the Court dismissed the motion.
During the hearing before the Appeals Court on Tuesday, November 8, 2022, Counsel for Ashantigold SC informed the court of their decision to withdraw the application having apprised themselves of the preliminary legal objection raised by the GFA in its Affidavit in opposition.
Following the withdrawal, the GFA requested for cost of Thirty Thousand Ghana Cedis (GHc30,000) while Ashantigold SC pleaded to pay Three Thousand Ghana Cedis (GHc3,000).
The Appeal Court after listening to the plea of Ashantigold SC, however awarded cost of Five Thousand Ghana Cedis (GHc5,000) against Ashantigold SC.
Background:
The Miners were found guilty of match manipulation in their 2020/21 matchweek 34 Ghana Premier League fixture.
On 17th July 2021, Ashantigold SC hosted Inter Allies FC in the 2020/21 Ghana Premier League Matchday 34 game at the Obuasi Len Clay Stadium.
Post match reactions from Social media reveals that the game was fixed to fulfill a correct score of 5 goals to 1 in favor of Ashantigold SC.
The match eventually ended with 7 goals in favour of the Miners.
Inter Allies defender Hashmin Musah confessed to having scored two intentional own goals on purpose to alter a results planned with a betting syndicate.
Consequently, the the GFA Appeals Committee stated that evidence available to the Committee supports the conclusion reached by the Disciplinary Committee that the match was not played competitively or under competitive circumstances.
As a result, President of Ashantigold SC Dr. Kwaku Frimpong and his son, Emmanuel Frimpong ( CEO of Ashantigold SC ) have been served with 10 years and 8 years ban from football activities respectively in accordance with Article 34.5(d)(i) of the Ghana Premier League Regulations 2019 .
A fine of GHc100,000 is imposed on Dr. Kwaku Frimpong as well as a fine of GHc 50,000 is imposed on the Club’s CEO, Emmanuel Frimpong.
Eight players of the club have also been banned for two years each after being found guilty of match manipulation, while a further five players have also been handed four year bans for failure to appear before the GFA’s Disciplinary Committee.
Players and Officials of Inter Allies FC also were charged for breaching Article 34(5)(a) of the GFA Premier League Regulations.
Inter Allies are to pay a fine of GHS 100, 000 in accordance with the GFA’s Disciplinary Code.
