The Supreme Court has granted a motion for substituted service in the case of the disputed Assin North Member of Parliament, James Gyakye Quayson.
By necessary implication, the Writ of Summons against Mr. Quayson will be published in the Daily Graphic Newspaper once, and it becomes valid after 7 days of the publication.
In this matter, Michael Ankomah Nimfah is seeking to injunct James Gyakye Quayson from carrying himself out as the Member of Parliament for Assin North.
His writ is based on an earlier High Court decision that invalidated the Assin North Parliamentary elections and ordered a re-run of the process.
The Lawyer for the plaintiff, Michael Ankomah-Nimfa, led by Frank Davies, moved the motion paper and the affidavit in support, which were filed on February 15, 2022, seeking the substituted service.
He brought to the attention of the Court that a Bailiff attached to the High Court in Assin Fosu, had filed an application of non-service, indicative of yet another inability to serve the process on Mr. Quayson.
The Court was composed of Justices Jones Dotse as President, Prof. Henrietta Mensah Bonsu, Mariama Owusu, Agnes Dordzie, Nene Amegatcher, Gertrude Torkornor and Yoni Kulendi.
The case has been adjourned indefinitely.
